Privacy Policy

By using or accessing www.thermos.com or www.thermosbrand.ca ("Websites"), you signify your acknowledgment and assent to the Privacy Policy set forth below. If you do not agree to this policy, DO NOT use either of the Websites. Thermos L.L.C. can revise this policy at any time by updating this posting, and your use after such change signifies your acceptance of the changed terms. However, any changes will not apply to any disputes of which the parties have actual notice on or prior to the date the change is posted on either of the Websites. Please check these terms of use periodically for changes. For your convenience, when any changes are made to this policy, we will endeavor to update the "last modified" date identified above.

This policy is intended to help you understand how Thermos L.L.C., its subsidiaries, parents, and affiliates ("Thermos", "we", or "us") collect, use, and safeguard the information you provide on our Websites.

This policy is a part of the Terms of Use

Personal Information

If you browse any Thermos Websites, you may generally do so anonymously without providing any personal information. However, there are cases in which we may ask you for personal information or you may provide personal information. For example, we will occasionally conduct on-line surveys to better understand the needs and profile of our visitors. In addition, we may request personal information when you register to receive additional information regarding our products and services, enter to win a prize via a promotion, or send us a question. Even if you choose not to give information we request, you can still visit most portions of the Thermos Websites, but you may be unable to access certain options, promotions, offers, and services.

Orders

The Websites may use a third party vendor to provide purchasing and other online retail services. When you place an order for a product, Thermos or our third party vendor needs to know your name, e-mail address, mailing address, address associated with credit card, and credit card number and expiration date. This personal information is required so that Thermos or our third party vendor can process and fulfill your order, send an order or shipping confirmation, as well as notify you of your order status. All Internet transactions with Thermos or our third party vendor are performed on a secure server that encrypts your credit card information to minimize the likelihood that unauthorized third parties can access such information.

Thermos Mailings

If you provide us with personal information, we may place you on a list to receive emails regarding product updates, special offers, important issues, or new products. To help us implement such emails, we may share your personal information with our third party marketing advisors such as a public relations company or email marketing company. If you do not wish to receive e-mail updates, please click the "unsubscribe" link available in the email we send to you or contact us at the contact points specified below.

Use of Personal Information

We may use the personal information you provide for marketing and promotional purposes or to investigate or respond to a specific request you submit to us. Thermos does not rent, sell or otherwise distribute to third parties, your personal information entered on the Websites, other than as described in this policy. We also may use your personal information for additional purposes as expressly described in the Official Rules posted for each promotion (e.g., contest or sweepstakes). While we use reasonable efforts to safeguard the confidentiality of your information, Thermos will have no liability for disclosure of any information obtained due to errors in transmission, the unauthorized acts of third parties, or other inadvertent disclosures made despite our reasonable efforts to prevent such disclosures.

We may share statistical or aggregated non-personal information about our users with advertisers, business partners, sponsors and other third parties. This data is used to customize website content and advertising to deliver a better experience to our users.

Cookies and IP Tracking

The Websites may use cookies for administration purposes. If, for any reason, you do not wish to not take advantage of cookies, you may be able to set your browser to block them. Such settings may disable some, but not all of the cookies operating on the Thermos Websites. Also, such settings may disable or render unusable some of the features of the Thermos Websites.

In addition, the Websites may use some third-party services, such as Google Analytics, that may use cookies to collect non-personal information. Google provides an explanation of how Google Analytics collects and uses information at the following link: https://support.google.com/chrome/answer/2790761?hl=en. (This link is provided for your convenience, but the URL may change or become unavailable at any time.)

The Websites also may detect and use your IP address or domain name for internal traffic monitoring and capacity purposes or to otherwise administer our Websites. No personal information is obtained, rather just the patterns of usage of our various users may be tracked to provide you with improved service and content based on aggregate or statistical reviews of user traffic patterns.

Special Cases

Thermos reserves the right to disclose user's personal information in special cases. For example, when we have reason to believe that disclosing this information is necessary to identify, contact, or bring or respond to legal action involving someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other users of Thermos Websites, or anyone else that could be harmed by such activities. Also, we may disclose user's personal information to cooperate with law enforcement authorities. To help us prepare for, respond to, or implement any legal actions, we also may disclose your personal information to our third party legal advisors or our third party insurance advisors. In addition, we may disclose personal information without notice to you in response to a subpoena or discovery request, when we believe in good faith that the law requires it, when all of our business assets are being sold to a third party, or to respond to an emergency situation.

Policies for Children

We encourage parents and guardians to monitor and participate in their children's online activities. No information should be submitted to the Websites by users under 13 years of age, and users under 13 years old are not allowed to register for newsletters or other emails. In addition, users under 18 years of age are not allowed to make purchases. Where appropriate, Thermos may ask you to indicate your age to verify compliance with these policies. Thermos does not knowingly collect information from our users under 13 years of age or provide any personally identifying information from such users to any third party for any reason whatsoever. We do not allow users known to be under 13 years of age to receive direct marketing communications from Thermos or from our third party advisors.

The Websites also may contain links to mobile applications (e.g., OasisPlaces by Thermos or other mobile applications), which may be controlled by Thermos. Even the applications that are controlled by Thermos are subject to their own Privacy Policy. See iTunes Websites for the mobile application or mobile application legal policies for more details.

Changes to Policy

Thermos also reserves the right to change or update this policy, or any other policy or practice, at any time. Any changes or updates will be effective immediately upon posting to the Thermos Websites. However, any changes will not apply to any disputes of which the parties have actual notice on or prior to the date the change is posted on either of the Websites.

Your continued use of either of the Websites following the posting of revised Terms of Use means that you accept and agree to the changes. While we may inform you of changes we make to the Terms of Use via a banner, changing the "last updated" date, or other notification, you are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

BPA Free Why it matters

Bisphenol A

Bisphenol A (BPA) is a controversial chemical that can be found in the lining of food cans, certain water bottles and more. Some researchers have linked the hormone-mimicking chemical to a host of issues including behavioral and developmental effects in kids. Thermos plays it safe, and has made a commitment to only manufacture products that are BPA-free.
